2011 Summer School Terms & Conditions

 

Application Fee and Deposit:

In order to enroll and begin coursework, there is a one-time non-refundable Application Fee of $50 (for new enrollees only). School tuition must be paid in full.1 For any questions, the Responsible Party may contact the Student Accounts Office at 866.609.6351.

 

1 Kaplan College Preparatory School will issue transcripts upon successful completion of enrolled courses. The Application Fee is NON-REFUNDABLE.


Terms and Conditions:


Course Loads

a.     Course offerings are delivered in a 4 -week (semester) format.

b.      Four-week courses are referred to as half-credit courses.


Termination of Enrollment

The Student’s enrollment with KCPS may be terminated as follows:

 

a.     KCPS may terminate the Student’s enrollment at any time should KCPS, in its sole discretion, deem it to be in the best interest of KCPS. In addition, KCPS may terminate the Student’s enrollment should it determine that, in its sole discretion the conduct of the Parents is not in the best interests of KCPS.

 

b.     KCPS may terminate the Student’s enrollment for a violation of the terms, conditions, rules, and regulations of this Agreement and/or the Additional Terms and Conditions, as well as any material breach of this Agreement.          

 

c.     The Student’s enrollment will terminate immediately upon the failure of the Responsible Party to pay the agreed amounts or any part thereof as due.

 

d.     The Responsible Party may terminate the Student’s enrollment at any time, subject to the terms, conditions, rules, and regulations set forth herein.

 

Refunds upon Termination of Enrollment

The Responsible Party will remain liable for the full tuition payment, despite termination of this Agreement for any reason. No portion of the Application Fee will be refunded and no portion of the course tuition will be refunded after the Grace Period (as defined below).

 

Dropping of a Course and Refunds

Within the first 5 business days of Student's enrollment in a KCPS course (“Grace Period”), the Responsible Party may request to have the Student drop the course without penalty. After the 5 day Grace Period, there will be no refunds. A student must make a written request to the KCPS Academic Coach to cancel the program within the Grace Period and will be issued a refund for all money paid to KCPS, less the Application Fee. Refunds will be issued within 60 days of the drop or withdrawal request. Courses dropped after the Grace Period will not be eligible for a refund.

 

Course Change Policy

During the Grace Period (as defined above), Student may request to change to another course without financial penalty. At any time thereafter, if Student desires to change to another course, an administrative charge of $150 per course will be applied to Student’s account to effectuate the change. After the Grace Period, an additional 5 business days is granted for requests to switch from an honors course to a regular level of the same course. An administrative charge of $150 per course will be applied to honors-to-regular course changes after the Grace Period plus an additional 5 days. All course change requests must be reviewed and approved by the Student’s KCPS academic advisor. Honors courses are only available to Student at the beginning of a full-credit course, unless the first half credit of the course has been issued as honors.

 

Representations

The Responsible Party represents that the information provided in this Agreement and any other documents submitted to KCPS for enrollment purposes is true and correct. Any misstatement or misrepresentation in applying for enrollment at KCPS shall be considered a misrepresentation in this Agreement and shall constitute a breach of this Agreement and shall be a basis for termination without refund or relieving Responsible Party of agreed financial obligations.

 

International Students

Tuition payment must be made in U.S. funds only. Students in Canada and foreign countries will be responsible for payment of any applicable customs duties or taxes.

 

Insufficient Funds

A $30 fee will be applied to a Student’s account if payment is made by check that is returned for insufficient funds. A $30 fee also will be applied to the Student’s account if payment is made by credit card that is declined for insufficient funds. The fee for insufficient funds will be charged per each occurrence.

 

Special Consideration on Payment

In case of Student illness or accident, death in the family, or other circumstances beyond the control of the Student, the Student shall be entitled to special consideration: KCPS, at its option, may settle the Student's account for an amount which is a lesser charge to the Responsible Party than that called for by KCPS established policy.

 

Substitution of Courses

Lessons, texts, and course materials are included in the tuition for each course you select. At its sole discretion, KCPS reserves the right to substitute course materials of equal or superior value. Course materials and curriculum are copyright protected, but Students may print pages for their own educational use.

 

Student Placement  

Placement of the Student is dependent upon successful completion of his/her current grade level at the Student’s present school. KCPS reserves the right to make final decisions regarding the academic grade placement of the Student. To receive credits for courses completed at prior institutions, official transcripts must be submitted for review and approval by KCPS.

 

Student Performance

KCPS reserves the right to reevaluate the Student after the first term. At that time, if KCPS decides that KCPS is not meeting the Student’s needs, alternative placements will be discussed.

 

Release of Student Records

KCPS will comply with all applicable laws, including Family Education Right and Privacy Act (12 U.S.C.A. Paragraph 1232 (g)), regarding the release of the Student’s records. KCPS reserves the right not to release the records of any Student for whom a balance is due to KCPS. KCPS will provide the Responsible Party with the KCPS Family Educational Rights and Privacy Act (FERPA) Consent Form.

 

Release for Public Use of Student Image or Coursework

The names of KCPS students, their images, and their coursework will not be published on the KCPS website or in videos without a Responsible Party’s consent; such consent to be given in writing by signing a Media Release.

 

Marketing Lists

KCPS occasionally makes its customer list available to other affiliates or subsidiaries of Kaplan, Inc. If Student or Responsible Party does not wish to be contacted by Kaplan, Inc. companies, please notify KCPS, 4601 Sheridan Street, Suite 600, Hollywood, FL 33021, in writing that you wish to be removed from the customer list.

 

Arbitration Clause

Any controversy or claim arising out of or related to this Agreement, or breach thereof, no matter how pleaded or styled, shall be settled by arbitration in accordance with the Commercial Rules of the American Arbitration Association, and judgment upon the award rendered by the Arbitrator may be entered in any court having jurisdiction. In no event shall KCPS be liable for any consequential, incidental, special, punitive, or multiple damages of any kind.

NOTICE: Any holder of this consumer contract is subject to all claims and defenses which the debtor could assert against the seller of goods or services obtained pursuant hereto or with the proceeds hereof. Recovery hereunder by the debtor shall not exceed the amount paid by the debtor under this Agreement.

 

Delayed Performance

Except for the obligation to make payments when due, all other obligations under this Agreement shall be suspended for so long as one or both parties hereto are prevented from performing hereunder by acts of God/nature, the elements, acts of federal, state or local governments, agencies or courts, damage to or destruction or unavoidable shut-down or necessary facilities, or other matters beyond their reasonable control; provided, however, that any party so prevented from complying with its obligations hereunder shall promptly notify the other party thereof and shall exercise due diligence to remove and overcome the cause of such inability to perform as soon as practicable.

 

Notices

Any and all notices, payments, reports and other correspondence required hereunder shall be deemed to have been properly given or delivered when made in writing and delivered personally to the Responsible Party or KCPS at their respective addresses set forth in this Agreement, or when sent by United States mail with all necessary postage or charges fully prepaid. Notices may be sent to a new address for either party after written notice of such address change is given to the other party.

 

Waiver A waiver by any party of any provision hereof, whether in writing or by course of conduct or otherwise, shall be valid only in the instance for which it is given, and shall not be deemed a continuing waiver of said provision, nor shall it be construed as a waiver of any other provision hereof.

 

Severability

In the event that any provision of this Agreement, or any operation contemplated hereunder, is found by an arbitrator or court of competent jurisdiction to be inconsistent with or contrary to any law, ordinance, or regulation, the latter shall be deemed to control and the agreement shall be regarded as modified accordingly and, in any event, the remainder of this Agreement shall continue in full force and effect.

 

Binding Agreement

This Agreement is a legally binding contract when signed by the Responsible Party and accepted by KCPS. The Responsible Party’s signature on this Agreement indicates that he/she has read and understood the terms of this Agreement and understood any literature he/she has received from KCPS including the Student Handbook and that the Responsible Party believes that the Student has the ability to benefit from the program he/she selected. KCPS is confident in its program. Notwithstanding, KCPS provides the cancellation and refund policy as described above.

The Responsible Party may request cancellation by submitting a statement signed by him/her. This statement must be faxed to KCPS at 800.878.3152 or mailed to its office at 4601 Sheridan Street, Suite 600, Hollywood, FL, 33021.

 

Transfer Credit Disclaimer

By agreeing to this conditions, Responsible Party verifies that he/she is solely responsible for contacting any school and determining the acceptability of credits earned from KCPS by any such school.  Responsible Party understands and agrees that KCPS cannot guarantee that credits earned from KCPS will be accepted by any school, including, without limitation, any secondary or postsecondary institution.
